1. No Automatic Attorney–Client Relationship

Participation in this offer and receipt of complimentary documents does not create an attorney–client relationship with our firm or with Monica M.M. Yempuku beyond the limited scope of preparing the promotional Power of Attorney documents. An attorney–client relationship will be established only after execution of a separate written engagement agreement.

2. No Ongoing Legal Representation or Retainer

This offer does not place our firm or any attorney on retainer, nor does it obligate the firm to provide ongoing legal advice, updates, or future representation. Any additional legal services beyond preparation of the promotional documents require a separate engagement and are billed at standard rates.

3. Limited Scope of Services

The complimentary documents provided under this promotion are limited to one Statutory Durable Power of Attorney and one Advance Health Care Directive per client. Preparation of these documents is offered as a limited-scope service only and does not include comprehensive estate-planning review, tax advice, trust drafting, litigation, or any other legal matters unless separately agreed to in writing.

4. No Guarantee of Completeness of Estate Plan

Powers of Attorney alone do not constitute a complete estate plan. You may require additional legal instruments, such as a will, revocable living trust, asset-transfer documents, or probate-avoidance planning, to ensure proper protection of your estate and loved ones.

5. Client Responsibility and Potential Waiver of Protections

If you decline to proceed with a comprehensive estate plan after consultation, you acknowledge that you may lack important legal protections, including those typically provided by wills, trusts, or other planning documents. By choosing not to proceed, you understand and accept responsibility for any resulting gaps in your estate planning.

6. Document Validity and Client Duties

Validity and acceptance of the complimentary documents may depend on proper execution, notarization, and compliance with Hawaii law. It is the client’s responsibility to ensure that their documents are executed, stored, and used correctly.

7. No Assurance of Outcome

The firm does not guarantee that third parties, financial institutions, or healthcare providers will accept your Power of Attorney documents in every circumstance. Acceptance depends on each institution’s policies and applicable law.

8. Offer Does Not Cover Non-Standard Situations

This offer applies only to standard Power of Attorney documents. Complex or non-standard situations — including corporate, business-entity, or multi-jurisdictional powers, or custom provisions — may require additional services billed at standard rates.

9. Subject to Conflict Checks

All services, including those provided under this offer, are subject to standard conflict-of-interest checks. If a conflict is identified, the firm may decline representation or preparation of documents.

10. Not Legal Advice Until Engagement
